TERMS AND CONDITIONS OF THE SWEEPSTAKES

1. Subject of the Terms and Conditions and Organizer

(1) These terms and conditions govern the conditions for participation in the raffle as well as any necessary rights transfers. The description and process of the respective raffle take place within the framework of the respective raffle action on the Facebook and Instagram pages of @albatroswork.

(2) The organizer of the raffle is ISM GmbH, Koggenweg 1, 59557 Lippstadt, Germany.

(3) By participating in the respective raffle, these terms and conditions of participation are accepted.

(4) The raffle is not affiliated with Facebook or Instagram and is not sponsored, endorsed, or organized by Facebook/Instagram.

2. Participation

(1) All individuals who have reached the age of 18 and have their residence in Germany are eligible to participate in the raffle. Employees of ISM GmbH and affiliated companies, as well as relatives of such employees, are excluded. Participation with fake identities or identities of third parties is not permitted.

(2) Eligible participants can enter the raffle by liking the Instagram post, subscribing to the Instagram accounts @albatroswork and @ismstore.official, and answering the participation question in the comment section under the post.

(3) Participation is possible until 16.03.2025, 11:59 PM. 

3. Prizes and Prize Notification

(1) We are raffling off a prize among all eligible participants: 

(2) The winner will be determined by random selection from all eligible participants within two working days after the end of the participation period. He/she also agrees to be contacted by us via email. 

(3) Only one prize is possible per participant.

(4) The prize is neither transferable nor can it be exchanged or paid out in cash.

(5) If circumstances occur that are not our fault, the respective winner accepts a reasonable substitute prize.

(6) The winner will receive an order code through which they can order the prize items free of charge. 

4. Granting of usage rights

 (1) By accepting the prize, the winner agrees that we may use their name for advertising purposes and may mention them in the context of publications related to this competition in public.

5. Liability and indemnification

(1) By participating in the competition, the participant releases Facebook and Instagram from any liability.

6. Exclusion

(1) A violation of these terms and conditions entitles us to exclude the respective participant from participation. This applies in particular if the participant provides false information or if used photos or other content (e.g., comments) violate applicable law or the rights of third parties. The same applies to comments that may be considered violent, offensive, harassing, or degrading, or that otherwise violate societal standards of decency.

(2) If the excluded participant is a previously drawn winner, the prize may be revoked afterwards.

7. Early termination and changes

We reserve the right to terminate the competition at any time, even without notice, in whole or in part, or to change its course if it is not possible to guarantee proper execution of the competition for technical (e.g., computer virus, manipulation of or errors in software/hardware) or legal reasons (e.g., prohibition by Facebook/Instagram).

8. Data protection

We are responsible for the collection, processing, and use of personal data of the participants, provided we process it ourselves. We will only use the participant's personal information and other personal data within the framework of the legal provisions of data protection law. We will only store, process, and use the information to the extent necessary for the execution of the competition or if there is consent from the participant. This also includes use for exercising the granted usage rights. The data will be used exclusively for the execution of the competition and will be deleted afterwards.

The participant can request information at any time about the personal data stored about them. Otherwise, our privacy policy applies accordingly, which can be found at https://www.ism-store.com/datenschutz is available.

9. Final provisions

(1) Should the terms and conditions contain invalid provisions, the validity of the remaining conditions shall remain unaffected.

(2) German law applies. Legal recourse to review the draw is excluded.
